  • Probate is the legal process where a person is given the responsibility to sell/transfer assets, pay debts, manage taxes, and distribute all other belongings in accordance with someone’s will. If a will is not available, assets are distributed via Washington's standard law process.

  • There is no set amount of time that probate takes, though it is often influenced by the following:

    • Removing the decedent’s name off titles to property

    • Assessing asset value & selling assets

    • Paying creditors & taxes

    • If a Notice to Creditors is involved, there may be a 4 month wait.

    • It can also take longer if a challenge to a Will is submitted.

  • A property usually cannot be sold or transferred prior to an administrator being appointed by the courts. Being mentioned in the will is still not enough to take ownership rights of a property. A will nominates someone to serve as personal representative, however the court grants the power to act. Once this is complete, a property may be rented or sold.
